You must agree to the Terms of Service set for by Little Hero Designs in order to receive hosting from us. The use of services from Little Hero Designs constitutes agreement to these terms.

 1. Copyright & Links
All design by Little Hero Designs is subject to Copyright laws in Australia. Work may not be attributed to other parties and unless the site created for you is changed totally then there must be a link to Little Hero Designs acknowledging them as the creator of the site. This applies for as long as the site is published.

2.) Payment Information
Work will not commence on your website until you have paid a 25% deposit. Before the "launch" or making your website live final payment must be paid and balances paid in full.

You agree to strict payment terms of 7 days from creation of invoices. You agree to supply appropriate payment for the services received from Little Hero Designs, in advance of the time period during which such services are provided.

You agree that until and unless you notify Little Hero Designs of your desire to cancel any or all services received, those services will be billed on a recurring basis. Cancellations must be done in writing and sent to admin@littleherodesigns.com.au

 If your payment is late, you have a seven day grace period to bring your account up to date. If your payment is not received by the seventh day, your design creation will cease and you will receive an email. 

Little Hero Designs reserves the right to change the monthly payment amount and any other charges at anytime. Little Hero Designs will take whatever steps necessary to recover owed payments.

3.) Backups and Data Loss
Your use of the service is at your sole risk. Little Hero Designs is not responsible for files and/or data residing on your account once your project is complete. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on your chosen server/s.

4.) Cancellations and Refunds
 Little Hero Designs reserves the right to cancel the account at any time with or without notice. Any abuse of our staff in any medium or format will result in the suspension or termination of your services. Refunds will not be provided.

5.) Price Change
 The amount you pay for your web design will never increase from the date of purchase without consultation by Little Hero Designs and the customer. We reserve the right to charge extra for services required once the customer has agreed to launch their site.

6.) Content
All services provided by Little Hero Designs may only be used for lawful purposes. The laws of Australia apply. The customer agrees to indemnify and hold harmless Little Hero Designs from any claims resulting from the use of our services. Examples of unacceptable material include: IRC Bots, Torrents, Proxy Scripts / Anonymizers, Pirated Software / Warez, ".img" / image hosting only sites that do not host an actual domain name, Escrow, High-Yield Interest Programs(HYIP),  Auto/Manual surf sites, Bank Debentures, Bank Debenture Trading Programs, and Prime Banks Programs, lottery sites, hate sites, any porn sites ,hacker focused sites/archives/programs, sites promoting illegal activities.

 We reserve the right to refuse service to anyone. Any material sent to us for design that in our judgement is obscene or threatening is prohibited and will be removed from our files with or without notice.

7.) Indemnification
 Customers agree that it shall defend, indemnify, save and hold Little Hero Designs harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Little Hero Designs, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Little Hero Designs against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Little Hero Designs; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) Little Hero Designs ’s server.

8.) Disclaimer
 Little Hero Designs shall not be responsible for any damages your business may suffer. Little Hero Designs makes no warranties of any kind, expressed or implied for services we provide. Little Hero Designs disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Little Hero Designs and its employees.

9.) Disclosure to law enforcement
 Little Hero Designs may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

10.) Changes to the Terms
 Little Hero Designs reserves the right to revise its policies at any time without notice.
